Waivers of the Interview for few Nonimmigrant Visa Applicants

After discussions with the Branch of Country Security about the Waivers of the Interview for a few Nonimmigrant Visa Applicants. The Secretary of State has decided that the following interview waivers are in the public interest. Consular officials have the power and watchfulness. They make changes to defer the in-person interview for:

  • First-time H-2 visa applicants (temporary agricultural and non-agricultural workers); and
  • Other nonimmigrant visa applicants applying for any nonimmigrant visa classification who:
    • Were previously issued a nonimmigrant visa in any classification, unless the only prior issued visa was a B visa; and
    • Are applying within 48 months of their most recent nonimmigrant visa’s expiration date.

Legal Requirements for the Waivers of the Interview for Few Nonimmigrant Visa Applicants

Applicants must always meet certain legal conditions. This makes them eligible for an interview waiver. The authority will come into effect on January 1, 2024, and we will review it every year after that. This authorization is valid for the foreseeable future.

Until further notice, applicants may waive their interview needs. To be eligible, they must renew a nonimmigrant visa in the same classification. They must do this within 48 months of the previous visa’s end date.

To be eligible for an interview waiver, applicants must also meet certain criteria, including that they:

  • apply in their country of nationality or residence.
  • have never been refused a visa (unless such refusal was overcome or waived).
  • have no apparent or potential ineligibility.

Consular officials might expect face-to-face meetings in some cases. This could be due to the situation or local conditions. We urge candidates to refer to international haven and department sites. There, they can find more detailed data about visa application necessities and procedures. They should also get familiar with the embassy’s operating status and services.
